Overview

In this policy, Invivo, we, our and us mean Invivo Medical Pty Ltd. You or your means any individual about whom Invivo may need to collect personal information, as defined in the National Privacy Principles.  Invivo is bound by the National Privacy Principles as outlined in The Privacy Act 1988.   This policy communicates the collection and use of personal information by Invivo, as well as your rights of access to this information and the process to follow if you wish to lodge a complaint in relation to a breach of your privacy.

Invivo will only seek to collect information about you that is necessary or relevant to your business relationship with us, or is required by regulatory authorities, both federal and state.  We will be fair about the way in which we collect this information, and wherever possible will collect it directly from the person concerned, or another person authorised to supply the information. 

We train our employees about privacy and about our core values and culture which require professional and sensitive handling of information about people.  If an employee breached either this policy or the employee code of conduct we would take disciplinary action.

1.0         What type of information does Invivo hold?

Invivo will generally seek to collect the following personal information from our clients:

  • Name and address
  • Date of birth
  • Contact details
  • Gender
  • Professional details
  • Bank details
  • Tax file number – where necessary
  • ABN
  • Your employer’s name
  • Relevant information about your medical practice and procedures
  • Other information necessary to process an application for cover or to administer a claim

We will keep this information secure.  Our premises will be secured to control access by people other than staff.  Locked cabinets will be provided for physical security, and access to computer based records will be limited only to people who have an appropriate need to access the information.

Invivo also takes electronic security of its computer systems and the records stored thereon very seriously, and have measures in place to protect them from unauthorised access.

Any personal information held by Invivo that is no longer required will be disposed of in a safe and secure way, or permanently de-identified.

At times Invivo will also need to collect relevant personal information about your patients.  We will advise you that you need a privacy policy and that you must inform your patients that you may from time to time pass information to insurers.

2.0         How will Invivo use this information?

We will use this information for the purposes of providing you with protection, claims administration, regular information and updates, risk management and loss prevention services.  We will use this information for the purposes of general policy administration and billing. 

We may also use this information from time to time to advise you of ancillary events, programmes and services which we believe will be of interest to you.  If you do not wish to receive such information, you may simply advise us of this by emailing us at privacy.officer@invivo.com.au.

3.0         Will Invivo share this information with other parties?

In the provision of these services, Invivo may be required to disclose information to third parties, including our re-insurance broker and underwriters, solicitors, actuaries and government regulatory bodies.  We may also disclose your information:

  • In an emergency
  • In an investigation of suspected criminal activity
  • Where authorised or required by law

We may share de-identified information with third parties for the purposes of analysis and research to help improve health care outcomes.

4.0         How does Invivo handle a request for access to personal information?

Under the National Privacy Principles you are generally entitled to access the information we hold about you.  Where you are entitled to access, the time required to give you access may depend on the type of information requested.  We will answer your question as soon as we reasonably can – often immediately.

Sometimes we will ask that you put your request in writing, for example where you want copies of material or access to older information or where it is necessary for us to retain a copy of your request.

In some circumstances, in line with the legislation, we may charge you a fee for giving you access, which will vary but will be based on our costs in locating the information and the form of access you require.  If we propose to charge a fee for giving access, we will give you an estimate of the fee so you can confirm that you still want us to give you access to the information.

If we are entitled under the National Privacy Principles to refuse to give you access, and we choose to do so, we will tell you and explain why. 

6.0   What if some of the personal information we hold is incorrect?

We will seek to ensure that information is accurate when collected, used or disclosed.  Invivo will regularly update personal information.  Please tell us if you know that information we hold is incorrect.  Unless we disagree with you about the accuracy or completeness we will generally correct it on request.  If we disagree, we will explain why.

7.0         How do you make further enquiries or complain about a breach of privacy?

8.0         Changes to this policy

We reserve the right to update and amend this Privacy Policy from time to time and to notify you either by posting an updated version on our web site or in writing, either electronically or by paper correspondence.

9.0         Use of cookies

A cookie is a small, text-based file used frequently on some websites.  They can be permanently stored on your hard drive (persistent cookie) or in your computer’s memory (session cookie).  For members-only sessions requiring identification and log in, cookies will be necessary.

Invivo may use session cookies to interact with your browser.  These cookies are designed to make the exchange of information between your computer’s browser and our computer systems more efficient.  Other cookies may be used to collect information about the use of our website.  This helps us to make our website more useful to you.  We may use third party service providers in the collection of this information and its analysis, however the collection of this information does not identify you.  We do not use cookies to collect information which can personally identify you.
